Owner sues to get back Rose photo

        Anthony Kelly always suspected his photograph of Pete Rose's record-breaking hit might be worth some money.

        Now he's afraid he won't be the one who cashes in.

        The Florence man sued a memorabilia collector Wednesday to recover his photo of Mr. Rose connecting on the hit that broke Ty Cobb's career record of 4,191.

        His lawsuit claims the collector, Jack Gilchrest, promised to help sell copies of the photo if Mr. Kelly gave him the original negative.

        After providing the negative, Mr. Kelly claims, he never saw it again.

        “It's one of those things that's difficult to put a price tag on,” said Steven Coffaro, Mr. Kelly's attorney. “The picture is so unique, we want to prevent it from getting out and being distributed.”

        Judge Melba Marsh will hear arguments from both sides Friday in Hamilton County Common Pleas Court.

        Mr. Gilchrest, former owner of the Walls of Fame collectibles store, could not be reached for comment. His store in downtown Cincinnati closed this year.

        The photo was taken Sept. 11, 1985, at the moment Mr. Rose struck a pitch during a Reds game against the San Diego Padres.

        The lawsuit does not estimate a price but asks for damages of more than $25,000.
